Supreme Court Denies Iowa Case Review - Des Moines News Story - KCCI Des Moines

The U.S. Supreme Court has declined to review a decision that prohibited a videotaped interview of a child who was to be used in the trial against her alleged abuser.

The case involves James Bentley, of Vinton. He is charged with second-degree sexual abuse in Linn and Benton counties for allegedly engaging in sex acts with a child under the age of 12.

The child, Jetseta Gage, of Cedar Rapids, was killed by his brother, Roger Bentley, in March 2005.

An Iowa Supreme Court decision now stands.

The state high court upheld a district court ruling that the videotaped interview was not admissible because the 10-year-old girl was not available to be cross-examined by the defendant.

This is STUPID. HE KILLED HER! What the… just… AGH! He can’t face his accuser because he killed her! GAH!

I’m moving out in the woods and forming my own country. This one I’m in now is too f’d up for salvaging.
